TEXT ORDER entered by Judge Sue E. Myerscough on 7/16/2021. The Court DENIES Plaintiff's Petition for Leave to Proceed in Forma Pauperis ("IFP") #3 . Plaintiff's trust fund ledger #4 shows an opening balance of $2,720 on May 12, 2021. On June 23, 2021, the day before Plaintiff filed his complaint, his trust fund balance was $1,500. Plaintiff received $50 and spent $1,350 on commissary, food items, and telephone fees during that time. Plaintiff filed his IFP petition on June 28, 2021, disclosing that he had $1,449 in his trust fund. "A litigant wishing to proceed in forma pauperis must show that he is unable to pay required filing fees." Merritte v. Templeton, 493 F. App'x 782, 784 (7th Cir. 2012) (citing 28 U.S.C. Sec 1915(a)(1). Because Plaintiff had not shown that he is impoverished, the Court directs Plaintiff to pay the $402 filing fee in full within fourteen days of the entry of this order. (KE) |
