Plaintiff has 21 days to file a motion for leave to file an amended complaint along with a copy of any proposed amended complaint, if Plaintiff believes he can state a non-frivolous claim. The court reserves ruling on Plaintiff's remaining motion. If Plaintiff does not file a motion for leave to file an amended complaint within 21 days this case will be dismissed with prejudice and Plaintiffs Motion for Leave to Proceed in Forma Pauperis #2 will be denied as moot.
