TEXT ORDER entered by Judge Colin Stirling Bruce on 12/9/21. The court has reviewed Plaintiff's Motion for Temporary Restraining Order #6 , in which Plaintiff requests injunctive relief be granted by December 15, 2021. However, according to the docket, Defendant has not yet been served in this matter and its response deadline to the Motion #6 is December 21, 2021. Therefore, the court notes that Plaintiff may be seeking the entrance of a temporary restraining order without notice pursuant to Fed. R. Civ. P. 65(b)(1); but there is no certification in the Motion #6 or accompanying Memorandum of Law #7 as to any efforts made to give notice to Defendant or the reasons why notice should not be required pursuant to Fed. R. Civ. P. 65(b)(1)(B). If Plaintiff's counsel has made efforts to give notice to Defendant of the filing of the Motion for Temporary Restraining Order #6 , Plaintiff may file a supplemental certification to that effect. Moreover, following notice to Defendant, the court encourages the parties to consider reaching an agreement regarding the issues presented in Plaintiff's Motion #6 , and the court will entertain entry of an agreed order. At this time, the court anticipates ruling on Plaintiff's Motion #6 solely on the pleadings, but the parties will be notified by text order if this matter is instead set for a hearing on the Motion.(BMG) |
