Filing 6 MERIT REVIEW ORDER entered by Judge Colin Stirling Bruce on 3/8/2022. Plaintiffs' motion for leave to proceed in forma pauperis #3 and #4 are DENIED with leave to re-file. The Clerk of the Court is directed to send the forms necessary for Plaintiffs to move for leave to proceed IFP to them. If Plaintiffs want to proceed IFP in their individually filed case, they must complete the form in its entirety. Otherwise, the Court will deny the motion, and Plaintiffs will need to pay the $402.00 filing fee, in its entirety, in order to proceed with his individual case. Plaintiffs' Complaint is DISMISSED WITHOUT PREJUDICE because it fails to state a claim upon which relief can be granted. 28 U.S.C. Sec 1915A; Fed. R. Civ. Pro. 12(b)(6). Plaintiffs are given leave to file a proposed amended complaint that complies with the dictates of this Order. Plaintiffs should file his proposed amended complaint within thirty (30) days from the date of this Order. If Plaintiffs fail to do so, the Court will dismiss this case. The Clerk of the Court is directed to send the forms necessary for Plaintiffs to file a new complaint under 42 U.S.C. Sec 1983. Finally, if Plaintiffs decide to proceed on their claim, they cannot proceed in this case together. Accordingly, either Plaintiff Moye-El or Newbill may proceed in this case, if that is his desire, but the other Plaintiff must file a new case with the forms provided by the Court. Each Plaintiff will be responsible for paying the filing fee for any cases filed. See written order. (KE) |
