TEXT ORDER entered by Judge Joe B. McDade on 04/29/2022. Plaintiff's #3 Motion is denied insofar as it requests a temporary restraining order; the Court defers ruling on the Motion insofar as it requests a preliminary injunction. The final day of instruction for the current semester at the University of Illinois College of Law is on Monday (05/02/22). See Academic Calendar, https://law.illinois.edu/academics/academic-calendar/. Given that Plaintiff had only attended three weeks of (what would have been) his final semester between 01/25/21 and 02/15/21, it is inconceivable that he could finish his final course in the single day of instruction remaining in the Spring 2022 semester. See doc. 1 para. 66; Spring 2021 Academic Calendar, https://registrar.illinois.edu/spring-academic-calendar-21/. Classes next resume on 08/22/22. Plaintiff's alleged imminent, irreparable injury will not occur for months; Defendants can certainly be heard in opposition before then. Therefore, Plaintiff has failed to "clearly show that immediate and irreparable injury, loss, or damage will result to the movant before the adverse party can be heard in opposition." Fed. R. Civ. P. 65(b)(1)(A). Furthermore, Plaintiff's attorney failed to "certif[y] in writing any efforts made to give notice and the reasons why it should not be required." Fed. R. Civ. P. 65(b)(1)(B); see doc. 3 (containing no mention of notice to Defendants or why it should not be required). However, Plaintiff's Motion for a preliminary injunction remains and would benefit from briefing from Defendants. Accordingly, Plaintiff is ordered to serve Defendants with summons, the Complaint, and the instant Motion. Defendants' response to the instant Motion is due within 14 days of the date it is served upon them. Once the Court has been informed that Defendants have been served with and have notice of the instant Motion, the Court will set a hearing on the Motion. In addition, Plaintiff is ordered to file a motion for leave to proceed anonymously within 14 days of the date of this Order (by 05/13/22). (DRS)
