May 25, 2022 Opinion or Order Filing 10 ORDER: Plaintiff John Johnson, a prisoner incarcerated at the Danville Correctional Center, brought this pro se civil rights action under 42 U.S.C. 1983. The Court severs any claims arising at the Danville Correctional Center against Wexford Health Sources based on treatment provided by Wexford staff at Danville into a new case with Wexford Health Sources as the sole defendant (the Court makes no findings as to the viability of any claims against Wexford based on events at Danville). The nature of suit code for the new case should be 555 and it should be directly assigned to the undersigned district judge. The Clerk is directed to file this Order and Plaintiff's submissions in this case #1 #3 4 #5 #6 #7 in the new case. Pursuant to 28 U.S.C. 1391(b) and 1404(a), the new case is transferred forthwith to the United States District Court for the Central District of Illinois, Urbana Division, for such further proceedings as that Court may deem appropriate, including consideration of Plaintiff's fee status in the transferred case. No summonses shall issue in the transferred case unless so directed by the transferee court. The portion of Plaintiff's amended complaint #7 (which also appears on the docket as #9 after Plaintiff paid the filing fee) asserting claims arising at the Stateville Correctional Center's Northern Reception and Classification Center (NRC) against Wexford and Dr. Sood is dismissed for failure to state a claim. Plaintiff may submit an amended complaint limited to alleged events at the NRC. If he fails to comply by July 11, 2022, the Court will dismiss this case for failure to state a claim. Plaintiff's motions for attorney representation #3 #7 for his NRC claims are denied without prejudice as Plaintiff states that he is still waiting to hear back from attorneys he has contacted and in any event, it is too early to determine if recruitment of counsel is warranted. The Clerk is directed to send Plaintiff an amended civil rights complaint form and a copy of this Order. Signed by the Honorable Franklin U. Valderrama on 5/25/2022. Mailed notice (cxr, )
