TEXT ORDER entered by Judge Michael M. Mihm on 9/1/2022. On 8/10/2022, Plaintiff filed a letter with the Court stating that he was denied due process and was never given the right to appeal because notices came after it was too late to respond. Out of an abundance of caution, the Court opened a new civil case and filed Plaintiff's letter as a Complaint. (Doc. 1). On 8/11/2022, the Court directed Plaintiff to inform the Court within 14 days whether he intended to file a new lawsuit. If that was not his intent, this case would be dismissed without prejudice and no filing fee would be assessed. The time period has passed, and Plaintiff has not notified the Court whether he intended to file a new lawsuit or filed any other pleading in this matter. Therefore, this case is dismissed without prejudice. No filing fee is assessed. The Clerk is directed to enter judgment and close this case.(SAG) |

The Court cannot determine whether Plaintiff intended to file a new lawsuit, and, out of an abundance of caution, the Court has opened a new case. Plaintiff shall, within 14 days of this Order, inform the Court whether he intended to file a new lawsuit. If he did, he must pay the $402.00 filing fee in full or file a petition to proceed in forma pauperis (IFP). Clerk is directed to send Plaintiff a blank IFP form..
