TEXT ORDER Entered by Judge James E. Shadid on 3/7/23.On February 21, 2023, the Plaintiff submitted a letter which was filed as a complaint pursuant to 42 U.S.C. 1983. #1 . The Court noted it was unclear if Plaintiff intended to pursue a lawsuit. See February 24, 2023 Text Order. Therefore, Plaintiff was given time to clarify. If he did intend to pursue a lawsuit, he was directed to file a complaint and either pay the fee or file a motion to proceed in forma pauperis. If not, the Court noted it would dismiss this case and no fee would be owed. Plaintiff has now responded stating he did not intend to open a lawsuit and would like this case dismissed. #3 . Plaintiff's motion to voluntarily dismissed is granted. #3 . This case is dismissed in its entirety and no filing fee is accessed.(ANW) |

TEXT ORDER entered by Judge James E. Shadid on 2/24/2023. Plaintiff sent a letter to the Court, which has been filed as a Complaint #1 . The Court cannot determine whether Plaintiff intended to file a new lawsuit, and, out of an abundance of caution, the Court has opened a new case. Plaintiff shall, within 21 days of this Order, inform the Court whether he intended to file a new lawsuit. If he did, he must pay the $402.00 filing fee in full or file a petition to proceed in forma pauperis (IFP). Clerk is directed to send Plaintiff a blank IFP form and a complaint form to assist Plaintiff. If Plaintiff did not intend to file a new lawsuit, he must state so in writing within 21 days of this order and no filing fee shall be assessed, and this case will be dismissed without prejudice. If Plaintiff fails to take any action, the Court will assume Plaintiff did intend to open a lawsuit, and he will be responsible for payment of the $402 filing fee.(SAG) |
