TEXT ORDER entered by Judge James E. Shadid on 4/5/2023. Plaintiff's Motions to Voluntarily Dismiss #3 and #4 are GRANTED. In his motions, Plaintiff states that he did not intend to file this case. Instead, Plaintiff asserts that he merely was making an inquiry with the Court as to how to file a lawsuit in federal court. Because the Court opened this case on his behalf and imposed a filing fee, Plaintiff asks the Court to close this case and to waive the filing fee because he did not intend to file this case. Based on Plaintiff's representations and pursuant to Federal Rule of Civil Procedure 41, this case is DISMISSED WITHOUT PREJUDICE. No judgment to enter. No filing fee will be imposed, and Plaintiff is not required to file for leave to proceed in forma pauperis. The Clerk is directed to send the forms necessary for Plaintiff to file a federal civil rights lawsuit under 42 USC 1983, so that he has them if, in the future, desires to do so. Plaintiff should understand that the Court cannot provide legal advice to litigants who appear before it. Southall v. AVI Food Sys., Inc., 2022 WL 1015001, *3 (N.D. Ind. Apr. 5, 2022) (holding that "the Court cannot give a litigant legal advice."). Plaintiff should also understand that, if he files a lawsuit in the future, the Court will impose the required filing fee, and the Court will not waive that fee.
