May 8, 2023 Opinion or Order TEXT ORDER entered by Judge Joe Billy McDade on 5/8/2023. Written correspondence the Court sent to Plaintiff at his address on record was returned as undeliverable. See #10 . On April 17, 2023, the Court ordered Plaintiff to show cause within 14 days as to why this case should not be dismissed for failure to keep the Court informed of his current address. (d/e 4/17/2023). The Court warned Plaintiff that failure to do so would result in the dismissal of this case with prejudice. Id. The Clerk sent a copy of the Text Order to Plaintiff's last known address. The correspondence was returned as undeliverable. See #11 . Plaintiff has not otherwise complied with the Courts order. This case is DISMISSED, with prejudice, for failure to prosecute. Fed. R. Civ. P. 41(b). Plaintiff's Petition to Proceed in forma pauperis #5 and Motion to Request Counsel #7 are MOOT. Although this case has been dismissed, Plaintiff remains responsible for paying the $402.00 filing fee. If Plaintiff wishes to appeal this dismissal, he may file a notice of appeal with this court within 30 days of the entry of judgment. Fed. R. App. P. 4(a). A motion for leave to appeal in forma pauperis should set forth the issues Plaintiff plans to present on appeal. See Fed. R. App. P. 24(a)(1)(C). If Plaintiff does choose to appeal, he will be liable for the $505 appellate filing fee irrespective of the outcome of the appeal.(ANW)
