Filing 53 Case transferred in from District of Illinois Southern; Case Number 3:22-cv-01981. . |
Filing 52 ORDER TRANSFERRING CASE TO OTHER DISTRICT: Each Defendant, and now Plaintiff, has filed a Motion to Transfer Venue. (Docs. #38 , #49 ). Under 28 U.S.C. 1391, as relevant here, a civil action may be brought in a judicial district in which any defendant resides, if all defendants are residents of the State in which the district is located, or a judicial district in which a substantial part of the events giving rise to the claim occurred. See 28 U.S.C. 1391(b)(1), (2). Here, Defendants are residents of different states, no Defendant resides in the Southern District of Illinois, and no events giving rise to Plaintiff's claims occurred in the Southern District of Illinois. Thus, venue is improper in this district. The Court, therefore, GRANTS the parties' motions and TRANSFERS this case to the Central District of Illinois pursuant to 28 U.S.C. 1406(a) (permitting transfer when there is lack of venue if "in the interests of justice"). Signed by Chief Judge Nancy J. Rosenstengel on 4/6/2023. (mlp) THIS TEXT ENTRY IS AN ORDER OF THE COURT. NO FURTHER DOCUMENTATION WILL BE MAILED. |
