June 6, 2023 Opinion or Order Filing 19 MERIT REVIEW ORDER entered by Judge Colin Stirling Bruce on 6/6/2023. Plaintiff's motion for leave to file supporting documents #12 is GRANTED, and the documents attached to his motion for leave are considered to be a part of his Amended Complaint. Plaintiff's motion for leave to file an amended complaint #11 is GRANTED, and the Clerk of the Court is directed to file Plaintiff's proposed amended complaint that is attached to his motion for leave to file. Pursuant to its merit review of Plaintiff's Amended Complaint under 28 U.S.C. Sec 1915A, the Court finds that the Amended Complaint states a First Amendment claim of denial of access to the court against Defendants Snyder, Bladgett, and Sapp. Any additional claims shall not be included in the case except at the Court's discretion and on a motion by a party for good cause shown or pursuant to Federal Rule of Civil Procedure 15. The Clerk of the Court is directed to effect service of process upon Defendants Snyder, Bladgett, and Sapp pursuant to the Court's standard procedures. The Clerk of the Court is further directed to dismiss all other named Defendants because Plaintiff's Amended Complaint fails to state a claim against them upon which relief can be granted. Fed. R. Civ. P. 12(b)(6); 28 U.S.C. Sec 1915A. The Clerk of the Court is directed to enter the standard qualified protective order pursuant to the Health Insurance Portability and Accountability Act. Plaintiff's motion for extension of time #15 and Plaintiff's motion regarding his trust fund ledgers #16 are DENIED as moot in light of this Order. Plaintiff's motion for leave to proceed in forma pauperis #3 is DENIED with leave to re-file. The Clerk of the Court is directed to send the form used by a nonprisoner plaintiff to move for leave to proceed in forma pauperis. Plaintiff must complete this form and must move for leave to proceed IFP based upon his current financial situation within twenty-eight (28) days from the date of this Order. If Plaintiff fails to move timely for IFP status, the Court will dismiss this case based upon his failure to pay the required filing fee. See written order. (KE)

May 10, 2023 Opinion or Order TEXT ORDER entered by Judge Colin Stirling Bruce on 5/10/2023. Plaintiff's motions for leave to file an amended complaint #7 and #8 are DENIED. Plaintiff has filed two motions seeking to add new party Defendants to his Complaint. However, the Court does not accept piecemeal amendments to pleadings. If he desires to amend his Complaint to add a Defendant, to add a claim, or to substitute a Defendant, Plaintiff should file a motion seeking leave to do so in which he identifies the changes that he desires to make in his Complaint. In addition, Plaintiff should attach a complete, proposed amended complaint that, if granted leave to file, will completely replace his original Complaint and will stand on its own without reference to or reliance upon his Original Complaint. Flannery v. Recording Indus. Ass'n of Am., 354 F.3d 632, 638 n.1 (7th Cir. 2004). The proposed Amended Complaint should explain what any and all Defendants did or did not do, including the proposed new Defendant(s), and why their actions or inactions violated Plaintiff's Constitutional rights. Plaintiff has up to and including May 26, 2023, within which to file a proposed amended complaint that contains all of the individuals whom he wants to name as Defendants. If Plaintiff does not file a proposed amended complaint by this deadline, the Court will conduct a merit review of his Original Complaint as required by 28 USC Section 1915A. (KE)
