TEXT ORDER entered by Judge Colin Stirling Bruce on 8/25/23. On August 7, 2023, the court dismissed #5 Plaintiff Cedric B. Johnson's pro se Complaint #1 for failure to state a claim, pursuant to 28 U.S.C. s. 1915(e)(2)(B)(ii). The court granted Plaintiff 21 days in which to file an amended complaint. Plaintiff has now filed an "Affidavit of Truth," which the court construes as an Amended Complaint #6 . However, that filing contains no material facts that were not already included in Plaintiff's Complaint #1 or his first Affidavit of Truth #3 , both of which the court considered in its original dismissal Order. It follows that the Amended Complaint #6 must again be dismissed for failure to state a claim, pursuant to 28 U.S.C. s. 1915(e)(2)(B)(ii). This dismissal is with prejudice. Plaintiff's pending Motions for Leave to Proceed in Forma Pauperis #2 , #7 are DENIED as MOOT. This matter is terminated. (DS) |
