December 7, 2023 Opinion or Order TEXT ORDER granting #3 Petition to Proceed In Forma Pauperis entered by Judge Michael M. Mihm on 12/7/2023. Pursuant to 28 U.S.C. Section 1915(b)(1), Plaintiff is assessed an initial partial filing fee of $9.10. The agency having custody of Plaintiff is directed to forward the initial partial filing fee from Plaintiff`s account to the Clerk of Court within 30 days of this order. After payment of the initial partial filing fee (or immediately if no funds are available for that payment) the agency having custody of Plaintiff shall make monthly payments of 20 percent of the preceding month`s income credited to Plaintiff`s account to the Clerk of Court. Income includes all deposits from any source, including gifts. The agency having custody of the plaintiff shall forward these payments each time Plaintiff`s account exceeds $10, until the filing fee of $350 is paid in full. The Clerk is directed to mail a copy of this order to Plaintiff`s place of confinement, to the attention of the Trust Fund Office, and to Plaintiff. (KE)

December 5, 2023 Opinion or Order TEXT ORDER entered by Judge Michael M. Mihm on 12/5/2023. Plaintiff filed his complaint #1 as an attachment to a motion in a closed case, C.D. Ill. Case No. 13-2033. That case had been closed for over eight years at the time Plaintiff filed his motion. The Court in that case denied Plaintiff leave to amend his complaint and directed the Clerk to open this new case. To ensure that Plaintiff does not unknowingly incur an additional filing fee he is directed to advise this Court within 14 days whether he desires to appeal the denial of his motions in 13-2033 or whether he desires to pursue his claims in an amended complaint in this new case. If Plaintiff files an appeal in 13-2033 he will have to pay the $605 appellate fees (all at once, or, if allowed, in installments over time). An appeal would be very difficult to win because of the many years that have passed since final judgment was entered in the 13-2033 case. If Plaintiff wants to pursue his claims in this new case, he will be required to pay an additional $405 filing fee, again all at one time or in installments if allowed. If Plaintiff wants to continue with this new lawsuit, he is warned that this suit is likely subject to dismissal because the issues have already been ruled on in 13-2033 and because the two-year statute of limitations almost certainly passed many years ago. Plaintiff has asked that the statute of limitations be tolled and the Court will address that request if Plaintiff intends to go ahead with this new lawsuit. If Plaintiff notifies the Court that he did not intend to file a new lawsuit the Court will dismiss this case and no filing fee will be assessed. If Plaintiff confirms that he wants to proceed with this new case, or if the Court does not hear back from Plaintiff within 14 days, the Court will proceed to rule on Plaintiff's motions to proceed IFP and for counsel, will enter a merit review order, and Plaintiff will owe the filing fee for this case.
