July 17, 2024 Opinion or Order Filing 5 ORDER TRANSFERRING CASE TO OTHER DISTRICT: Plaintiff Kendra O'Brien has submitted a civil rights complaint pursuant to 42 U.S.C. 1983, claiming her constitutional rights were violated while she was incarcerated at Decatur Correctional Center. Venue for federal civil rights actions brought under 42 U.S.C. 1983 is governed by 28 U.S.C. 1391(b); such actions may be brought only in (1) the judicial district where any defendant resides (if all defendants reside in the same State), (2) a judicial district in which a substantial part of the events or omissions giving rise to the claim occurred, or (3) a judicial district in which any defendant is subject to the court's personal jurisdiction with respect to the action, if there is no district in which the action may otherwise be brought. Because all events and omissions giving rise to Plaintiff's allegations occurred at Decatur Correctional Center in Macon County, Illinois, which is situated in the federal judicial district for the Central District of Illinois, the Court finds that the Central District is the appropriate forum for the hearing and determination of this case. Therefore, pursuant to 28 U.S.C. 1406(a), and on the Court's own motion, this action is TRANSFERRED to the United States District Court for the Central District of Illinois for a determination as to whether Plaintiff should be granted leave to proceed in forma pauperis, 28 U.S.C. 1915, and such further proceedings as that court may deem appropriate. July 17, 2024 Opinion or Order TEXT ORDER entered by Judge Michael M. Mihm on 7/17/2024. Plaintiff has filed a Complaint but has not paid the $405 filing fee nor filed a petition to proceed in forma pauperis. Within 21 days of the entry of this order, Plaintiff must pay the $405 filing fee in full or file a petition to proceed in forma pauperis with attached trust fund ledgers for the last 6 months. Failure to comply without good cause will result in dismissal of this case without prejudice, and the Plaintiff will still be responsible for payment of the filing fee. See 28 U.S.C. Sec. 1914.
