February 10, 2025 Opinion or Order TEXT ORDER entered by Judge Colin Stirling Bruce on 2/10/2025. Plaintiff's petition for leave to proceed in forma pauperis is granted #1 . Pursuant to 28 U.S.C. Section 1915(b) (1), Plaintiff is assessed an initial partial filing fee of $12.77. The agency having custody of Plaintiff is directed to forward the initial partial filing fee from Plaintiff's account to the Clerk of Court within 30 days of this order. After payment of the initial partial filing fee (or immediately if no funds are available for that payment) the agency having custody of Plaintiff shall make monthly payments of 20 percent of the preceding month's income credited to Plaintiff's account to the Clerk of Court. Income includes all deposits from any source, including gifts. The agency having custody of the plaintiff shall forward these payments each time Plaintiff's account exceeds $10, until the filing fee of $350 is paid in full The Clerk is directed to mail a copy of this order to Plaintiff's place of confinement, to the attention of the Trust Fund Office, and to Plaintiff. February 5, 2025 Opinion or Order Filing 5 MERIT REVIEW ORDER entered by Judge Colin Stirling Bruce on 2/5/2025. Plaintiff's motion for leave to file a complaint #4 is GRANTED, and the Clerk of the Court is directed to re-open this case. Pursuant to its merit review of Plaintiff's Complaint under 28 U.S.C. Sec 1915A, the Court finds that Plaintiff's Complaint states a medical claim in violation of his Fourteenth Amendment rights against Defendant. Any additional claims shall not be included in the case, except at the Court's discretion on motion by a party for good cause shown or pursuant to Federal Rule of Civil Procedure 15. The Clerk of the Court is directed to enter the standard qualified protective order pursuant to the Health Insurance Portability and Accountability Act. The Clerk is further directed to attempt to effect service of process on Defendant pursuant to the Court's standard procedures. Plaintiff's motion for leave to proceed in forma pauperis #1 is tentatively GRANTED. The Clerk is directed to obtain Plaintiff's prison trust fund legers so that the Court may verify the representations made by Plaintiff in his IFP motion regarding his claims of poverty and so that the Court may calculate the amount of any partial, filing fee that Plaintiff must pay in order to proceed in this case. January 22, 2025 Opinion or Order TEXT ORDER entered by Judge Colin Stirling Bruce on 1/22/2025. Plaintiff's motion for leave to proceed in forma pauperis #1 is DENIED. As the Court previously explained to him, Plaintiff must file a complaint or some equivalent pleading pursuant to Federal Rule of Civil Procedure 8 in order to invoke the Court's jurisdiction and in order to seek relief from the Court. Because he did not submit a complaint along with his IFP motion, the Court gave Plaintiff until January 21, 2025, within which to file a complaint or some equivalent pleading. The Court warned Plaintiff that, if he did not timely comply with the Court's Order and submit a complaint pursuant to Federal Rule 8, the Court would dismiss this case. As of today, Plaintiff has not submitted a complaint or otherwise complied with the Court's December 30, 2024 Order. Accordingly, this case is DISMISSED WITHOUT PREJUDICE based upon Plaintiff's failure to submit a complaint as required by Federal Rule 8, for failure to comply with the Court's December 30, 2024 Order, and for failure to prosecute this case under Federal Rule 41. December 30, 2024 Opinion or Order TEXT ORDER Entered by Judge Colin Stirling Bruce on 12/30/24. The Court has received a motion for leave to proceed in forma pauperis and a motion requesting counsel from Plaintiff. However, the Court has not received a complaint from Plaintiff. A complaint or some other equivalent pleading is necessary in order to file and to start a federal lawsuit. Until he files a complaint, the Court cannot determine whether Plaintiff intended to file a civil rights suit, a petition for habeas corpus, or what relief he is seeking from the Court. Accordingly, the Court will give Plaintiff twenty-one (21) days from the date of this Order within which to file a complaint or some other equivalent pleading that informs the Court what relief he is seeking from the Court. Until the Court can determine if it has jurisdiction over this matter, Plaintiff's motion to request counsel #2 is DENIED. If the Court does not receive Plaintiff's complaint within twenty-one (21) days from the date of this Order, the Court will deny his IPF motion and will close this case.(ANW)
