TEXT ORDER entered by Judge Michael M. Mihm on 7/14/2025. Plaintiff has filed a Motion to Voluntarily Dismiss #4 stating he wishes to voluntarily dismiss this lawsuit. Defendant has not yet been served. The motion is GRANTED. The Court finds, pursuant to Federal Rule of Civil Procedure 41(a)(1), that this cause has been properly dismissed without prejudice by Plaintiff. The Clerk is to TERMINATE this case. TEXT ONLY ORDER entered by Judge Michael M. Mihm on 5/12/25. Plaintiff, detained in the Ford County Jail, sent a letter to this Court and to the United States Attorney's Office. The Clerk docketed it as a Civil Complaint #1 . The Court directed Plaintiff to pay the filing fee or move to proceed in forma pauperis, or the case would be dismissed. Plaintiff has now filed a Motion to Correct the Court #3 which is GRANTED in part and DENIED in part. Plaintiff asserts that his initial letter was not a civil complaint, but rather that he is an Electronic Criminal Surveillance Officer and sent the letter for an undiscernible purpose related to a criminal investigation that he states he is involved in pursuing. The document appears to be a request that the Department of Justice initiate a prosecution.Plaintiff is allowed 14 days to provide a status report further clarifying his position. If he clearly states that he did not and does not want to pursue the subject matter of his letter as a civil action this case will be terminated and no fee will be due, as the initial document is not, on its face, intended to be a civil complaint. Alternatively, Plaintiff can continue to pursue this case as a civil action, and if he does so he must pay the filing fee or move to proceed in forma pauperis within 14 days of this Order.Plaintiff appears to want some action from the Department of Justice. But Plaintiff acknowledges that he does not have the authority to initiate criminal proceedings in this Court. His request that they look into the matter is as much as he can do in that regard. (VH)

TEXT ORDER entered by Judge Michael M. Mihm on 4/22/2025. Plaintiff has filed a Complaint but has not paid the $405 filing fee nor filed a petition to proceed in forma pauperis. Within 21 days of the entry of this order, Plaintiff must pay the $405 filing fee in full or file a petition to proceed in forma pauperis with attached trust fund ledgers for the last 6 months. Failure to comply without good cause will result in dismissal of this case without prejudice, and the Plaintiff will still be responsible for payment of the filing fee. See 28 U.S.C. Sec. 1914. The Clerk is directed to send Plaintiff the forms for proceeding in forma pauperis. (KE)
