MERIT REVIEW ORDER entered by District Judge Jonathan E Hawley on 11/14/2025. IT IS THEREFORE ORDERED: 1) According to the Court's merit review of Plaintiff's Second Amended Complaint under 28 U.S.C. Sec. 1915A, this case shall proceed on an Eighth Amendment claim against Defendants Ashley, Rose, Rachel, Jennifer, Ellison, and Ek based on their alleged deliberate indifference to Plaintiff's serious medical needs on March 12-21, 2024. Additional claims shall not be included in the case above, except in the Court's discretion on motion by a party for good cause shown under Federal Rule of Civil Procedure 15. 2) The Clerk is directed to ADD Ashley (Nurse) and Rose (Nurse) as Defendants. 3) Defendants Evelinea, Dykster, and the Warden of Danville Correctional Center are DISMISSED WITHOUT PREJUDICE for failure to state a claim pursuant to Federal Rule of Civil Procedure 12(b)(6) and Sec. 1915A. TEXT ORDER entered by District Judge Jonathan E Hawley on 9/25/2025. On 9/9/2025, this Court dismissed this case with prejudice after Plaintiff failed to file a Second Amended Complaint by 8/25/2025 as directed. Plaintiff now files a Motion for Leave to File Amended Complaint #17 , a Petition to Proceed in forma pauperis #15 , and a Motion to Request Counsel #16 . Plaintiff did not provide an explanation for missing the deadline to file his Second Amended Complaint. However, due to the recent dismissal and Plaintiff's status as a pro se litigant, the Court will reopen the case and allow Plaintiff to file his Second Amended Complaint. Plaintiff's Motion for Leave to File Amended Complaint #17 is GRANTED. The Clerk is directed to vacate the judgment, reopen this case, file the Second Amended Complaint, and set the merit review deadline 30 days out. Plaintiff's Petition to Proceed in forma pauperis #15 is MOOT, as the Court already granted Plaintiff's prior Petition to Proceed in forma pauperis on 6/16/2025. Regarding Plaintiff's request for counsel, the Court must consider: "(1) has the indigent plaintiff made a reasonable attempt to obtain counsel or been effectively precluded from doing so; and if so, (2) given the difficulty of the case, does the plaintiff appear competent to litigate it himself?" Pruitt v. Mote, 503 F.3d 647, 655 (7th Cir. 2007). The Court previously found that Plaintiff made a reasonable attempt to secure counsel on his own. Regarding his competency, Plaintiff indicated in his prior Motion to Request Counsel #10 that he completed some college courses. Thus far, his pleadings have been coherent and supported by accompanying exhibits. (Docs. 10 and 11). There is no indication that Plaintiff has any permanent physical or psychological condition that might impair his ability to litigate this case himself. The Court finds that Plaintiff appears competent to litigate the case himself, especially at this early stage in the litigation process. Plaintiff's Motion to Request Counsel #16 is DENIED.(SAG)

TEXT ORDER entered by District Judge Jonathan E Hawley on 9/9/2025. On 7/25/2025, this Court entered a Merit Review Order #13 pursuant to 28 U.S.C. Sec. 1915A and dismissed Plaintiff's Amended Complaint as a violation of Federal Rule of Civil Procedure 8. The Court gave Plaintiff 30 days to file a Second Amended Complaint and warned Plaintiff that the failure to do so would result in the dismissal of this case with prejudice. The time period has now passed, and Plaintiff has not filed a Second Amended Complaint or requested an extension of time. Therefore, this case is DISMISSED WITH PREJUDICE. The Clerk is directed to enter judgment and close this case. Plaintiff must still pay the filing fee of $350 even though his case has been dismissed. (d/e 6/16/2025) If Plaintiff wishes to appeal this dismissal, he must file a notice of appeal with this Court within 30 days of the entry of judgment. Fed. R. App. P. 4(a). A motion for leave to appeal in forma pauperis must set forth the issues Plaintiff plans to present on appeal. Fed. R. App. P. 24(a)(1)(C). If Plaintiff chooses to appeal, he will be liable for the $605 appellate filing fee irrespective of the outcome of the appeal.(VH)

IT IS THEREFORE ORDERED: 1) Plaintiff's Amended Complaint is DISMISSED WITHOUT PREJUDICE as a violation of Federal Rule of Civil Procedure 8. Plaintiff shall have 30 days from the entry of this Order to file a Second Amended Complaint. Failure to file a timely Second Amended Complaint or to follow the instructions in this Order will result in the dismissal of this case with prejudice. Plaintiff's Second Amended Complaint will replace Plaintiff's Amended Complaint in its entirety. The Second Amended Complaint must contain all allegations against all Defendants. Piecemeal amendments are not accepted. 2) Plaintiff's Motion to Request Counsel #10 is DENIED. 3) Plaintiff shall immediately inform the Court, in writing, of any change in his mailing address. TEXT ORDER granting #8 Petition to Proceed In Forma Pauperis. Pursuant to 28 U.S.C. Section 1915(b)(1), Plaintiff is assessed an initial partial filing fee of $58.82. The agency having custody of Plaintiff is directed to forward the initial partial filing fee from Plaintiff's account to the Clerk of Court within 30 days of this order. After payment of the initial partial filing fee (or immediately if no funds are available for that payment) the agency having custody of Plaintiff shall make monthly payments of 20 percent of the preceding month's income credited to Plaintiff's account to the Clerk of Court. Income includes all deposits from any source, including gifts. The agency having custody of the plaintiff shall forward these payments each time Plaintiff's account exceeds $10, until the filing fee of $350 is paid in full.
