| Filing 25 Joint MOTION to Stay the Case Pending Mediation by Defendant Communications Data Group Inc. Responses due by 12/4/2025 (Fouts, Gregory) |
TEXT ORDER: The parties have filed a #25 joint motion to stay the case. In it, they explain that they have agreed to mediate the dispute, that the mediation is set to take place in January 2026, and that a stay would avoid potentially unnecessary litigation. The Court finds this approach sensible. Accordingly, the parties' #25 motion is GRANTED and this case is STAYED. See Landis v. North American Co., 299 U.S. 248, 254 (1936) (explaining that district court has inherent power to stay proceedings). The parties are further ORDERED to file a status report within fourteen days of the conclusion of the mediation. Finally, the Court adopts the parties' suggestion that their post-mediation status report set forth proposed deadlines for the defendants responses to the plaintiffs' #22 consolidated class action complaint and a briefing schedule, if necessary. Entered by Magistrate Judge Ronald L. Hanna on November 20, 2025. (NL)

TEXT ORDER: Defendant Communications Data Group, Inc.'s ("CDG") #21 Unopposed Fourth Motion for Extension of Time to Answer or Otherwise Plead is GRANTED. Under Fed. R. Civ. P. 6(b)(1)(A), the Court may, for good cause, extend the time when a request is made before the original deadline expires. Here, the Court consolidated several pending cases on August 5, 2025. On September 18, 2025, the Court granted Plaintiffs' motion to appoint interim class counsel and set new deadlines for (1) Plaintiffs to file a consolidated class action complaint and (2) CDG to respond to that complaint. (See Doc. 19.) Given these circumstances, the Court finds good cause to extend CDG's time to respond to the individual complaints. Accordingly, CDG's deadline to respond to the Pierce and Watson complaints is extended to November 10, 2025. Entered by Magistrate Judge Ronald L. Hanna on October 14, 2025. (NL)
