February 4, 2026 Opinion or Order TEXT ORDER entered by District Judge Jonathan E Hawley on 2/4/2026. Plaintiff filed a Motion for Extension of Time #8 requesting an additional 120 days to file his Amended Complaint. Plaintiff states he has limited access to the law library due to lockdowns and a staffing shortage. Plaintiff states it will be easier to conduct legal research and draft his Amended Complaint after he is released from custody on 4/14/2026. Under the circumstances, the Court finds a 60-day extension of time is appropriate. Plaintiff's Motion #8 is GRANTED IN PART and DENIED IN PART. Plaintiff is directed to file his Amended Complaint by 4/10/2026. If Plaintiff fails to file a timely Amended Complaint, or if the Amended Complaint fails to state a claim for relief, his case will be dismissed with prejudice.(VH)

October 21, 2025 Opinion or Order TEXT ORDER entered by District Judge Jonathan E Hawley on 10/21/2025. Plaintiff filed a Petition to Proceed in forma pauperis ("IFP Petition") #3 . According to his prisoner trust fund ledger #4 , Plaintiff has $2,363.01 in his account. In his IFP Petition, Plaintiff states he receives an average monthly income of $286.45. In the last 12 months, Plaintiff states he received 11 monetary gifts from family and friends, but he does not indicate how much he received. Plaintiff has no money in a checking or savings account and no assets. Plaintiff states he spends $88.00 per month for food items, hygiene products, and stationary products and $39.00 per month for phone time, text messaging, and clothing items. Plaintiff has no debts, dependents, or financial obligations. Plaintiff states he will be released on parole in less than 6 months and is saving his money for an apartment, vehicle, phone, and other necessities. "Courts have broad discretion in assessing the sufficiency of an applicant's evidence of poverty, especially when it comes to prisoners, who have fewer demands on their income because prisons provide them with food, clothing, shelter, and medical care." See Maboneza v. Kincaid, 798 F. App'x 19, 23 (7th Cir 2020) (finding that inmate who had $1,500 in income in preceding six months was not destitute). The Court finds Plaintiff has sufficient means to pay the $405.00 filing fee in full, based on his lack of financial obligations and his balance of $2,363.01. Plaintiff's IFP Petition #4 is DENIED. Plaintiff will have 30 days from this Order in which to pay the $405.00 filing fee. The failure to pay the filing fee in full on or before 11/20/2025 will result in the dismissal of this case without prejudice. (SAG)
