At this time, the U.S. Marshals Service is completing service on the two late added Defendants. Plaintiff should wait until those Defendants appear in the case, at which point they will have the opportunity to respond to Plaintiff's Complaint. Once all Defendants have responded to the Complaint, the Court will rule on any motions to dismiss. As a reminder, this case is stayed until the Court rules on those motions to dismiss. March 25, 2026 Opinion or Order Filing 37 TEXT ORDER entered by Chief Judge Colin Stirling Bruce on 3/25/2026. Plaintiff has filed a Motion to Change Jurisdiction/Venue/Receive ADA Accommodations/Receive a Pro Bono Attorney for My Disability #21 . The name of the Motion notwithstanding, Plaintiff's only request is that this court transfer this matter to the Central District's Peoria Division. Plaintiff states that she seeks "an impartial surrounding for the judgment that is not within the community of [Defendant]." If Plaintiff is worried that a fair and impartial jury could not be selected, the court is confident that her concern is unfounded. Plaintiff also wants her case transferred to Peoria because "the US DOJ is housed in this location" and because she wants to be "in a jurisdiction where the Fair Housing Act and ADA are well known." It is unclear how the location of a Department of Justice office is relevant to this private civil action. And the court can assure Plaintiff that it is familiar with the pertinent federal statutes. A district court may, in its discretion, transfer a matter to any other division in the same district. 28 U.S.C. s. 1404(b). But Plaintiff has identified no good reason that this court should do so. And to the extent that Plaintiff's Motion might be construed as seeking recusal under 28 U.S.C. s. 455, Plaintiff has likewise failed to allude to any basis upon which the court's impartiality might reasonably be questioned. Accordingly, Plaintiff's Motion #21 is DENIED. (DS)

Plaintiff's Motion for Temporary Restraining Order #34 is DENIED, largely for the same seasons that her Emergency Motion for Preliminary Injunction #25 was denied, as explained in this court's Order 30 entered on March 12, 2026. In addition, the court notes that in the meantime Plaintiff's eviction proceedings have been remanded to the state court, such that injunctive relief would run afoul of the Anti-Injunction Act. See 28 U.S.C. s. 2283 ("A court of the United States may not grant an injunction to stay proceedings in a State court except as expressly authorized by Act of Congress, or where necessary in aid of its jurisdiction, or to protect or effectuate its judgments."); Bond v. JPMorgan Chase Bank, N.A., 526 F. App'x 698, 702 (7th Cir. 2013) ("No exception to the Anti-Injunction Act would appear applicable to the Fair Housing Act."); A.B. ex rel. Kehoe v. Hous. Auth. of S. Bend, 2011 WL 2692966, at *4 (N.D. Ind. July 8, 2011) (declining to enjoin eviction proceedings in part because the plaintiff's claims could "be raised as defense in the state court action"); Allen v. IRMCO Mgmt. Co., 420 F. Appx 597, 599 (7th Cir. 2011) (observing that Fair Housing Act claims could be raised as defense in state court eviction proceedings). (DS)

March 12, 2026 Opinion or Order Filing 30 TEXT ORDER entered by Chief Judge Colin Stirling Bruce on 3/12/2026. Plaintiff Stephani Ellis's original Complaint #1 in this case accused Defendant, Urbana Parc, LLC, of "ADA violations, Fair Housing violations," and a number of constitutional violations. She then Removed #8 to this court a state court eviction action pending in Champaign County Circuit Court, citing federal question jurisdiction as the basis for removal. Defendant has filed a Motion to Remand #14 the eviction action. Under 28 U.S.C. Section 1331, district courts have "original jurisdiction of all civil actions arising under the Constitution, laws, or treaties of the United States." "Removal based on federal question jurisdiction follows the well-pleaded complaint rule, which requires that the plaintiff's complaint itself raise issues of federal law." Samaha v. Burnside, 2023 WL 2808484, at *1 (C.D. Ill. Mar. 22, 2023) (citing Metropolitan Life Ins. Co. v. Taylor, 481 U.S. 58, 63 (1987)). Defendant's eviction complaint in the state court case seems to be a standard eviction complaint seeking possession of the premises under Illinois's Forcible Entry and Detainer Act, 735 ILCS 5/9-101. It involves purely state law claims. See Barrington Bank & Tr. Co., Nat'l Ass'n v. Fed. Deposit Ins. Corp., 2015 WL 1888284, at *5 (N.D. Ill. Apr. 24, 2015) ("[E]viction claims are state-law causes of action and are subject to the ordinary federal-jurisdictional rules governing state-law claims."). Defendant's Motion to Remand #14 is therefore GRANTED. Relatedly, Plaintiff has now filed an Emergency Motion for Preliminary Injunction to Prevent Retaliatory Eviction #25 . Her theory seems to be that she is being evicted for asserting her rights under the Fair Housing Act. While Plaintiff recognizes that a party seeking preliminary injunctive relief must demonstrate some likelihood of success on the merits, see Valencia v. City of Springfield, Illinois, 883 F.3d 959, 965 (7th Cir. 2018), her Motion provides no explanation for how she expects to prevail. The court is unable to even discern from her Amended Complaint #13 any sort of nexus between the myriad alleged violations of her rights and her eviction. Because Plaintiff has shown no likelihood of success on the merits, her Motion for Preliminary Injunction #25 must be DENIED. (RES)
