Plaintiff's Complaint #1 was removed to this court from the Macon County, Illinois, Circuit Court on December 19, 2025. His Complaint alleges Defendant Fuyao Glass Illinois, Inc., violated sections 15(a), (b), and (d) of the Illinois Biometric Information Privacy Act ("BIPA") (740 ILCS 14/1 et seq.) when it required Plaintiff to use a hand scan to clock in and out at work while employed with Defendant, without providing required disclosures and obtaining Plaintiff's written consent. Defendant moves to dismiss #11 the Complaint arguing, inter alia, Plaintiff admitted in a separate lawsuit that he signed a BIPA consent form containing the required notice, and had attached a copy of said form to a filing. It also argues Plaintiff's BIPA claims are preempted by the Labor Management Relations Act of 1947 (29 U.S.C. section 141 et seq.). Plaintiff responds #22 that he had no knowledge of these proceedings and affirmatively states: "I Danny Williams wish to dismiss all matters involving case number 2:25-cv-02332-CSB-EIL." He also attaches the same Biometric Information Consent Form referred to by Defendant, signed and dated June 7, 2022. Having considered the arguments in the Motion, Plaintiff's Response and exhibits attached thereto, Defendant's Motion to Dismiss #11 is GRANTED and the Complaint is dismissed with prejudice. See Gonzalez-Koeneke v. West, 791 F.3d 801, 807 (7th Cir. 2015) (granting leave to amend pleading not required where amendment would be futile). This case is terminated. (MLW)

May 5, 2026 Opinion or Order Filing 21 TEXT ORDER entered by Chief Judge Colin S. Bruce on 5/5/2026. On March 28, 2026, Magistrate Judge Eric I. Long entered a Text Order 17 granting Plaintiff's counsels' Motion to Withdraw #16 and directing Plaintiff to either obtain counsel or notify the court of his intention to proceed pro se. On April 23, 2026, Judge Long entered a Text Order 19 noting that no attorney had entered an appearance on Plaintiff's behalf and Plaintiff had not responded to the court. Thus, the stay on Defendant's pending Motion to Dismiss #11 was lifted and Plaintiff's deadline to respond to the Motion was set for May 14, 2026. On May 4, 2026, Plaintiff filed a letter #20 asking the court to strike any motions involving this case "due to it being fictitious and my signature was forged," among other things. Plaintiff is advised that his letter is not sufficient to respond to the pending Motion to Dismiss #11 . Plaintiff's response to the Motion to Dismiss is due by May 14, 2026. Plaintiff is again cautioned that failure to respond to the Motion will result in the court deeming the motion unopposed under Local Rule 7.1(B)(2) and ruling on the Motion without further notice. The clerk is directed to send a copy of this case's docket sheet to Plaintiff along with this Order to Plaintiff's last known address. (DS)

April 23, 2026 Opinion or Order Filing 19 TEXT ORDER entered by Magistrate Judge Eric I. Long on 4/23/2026. On 3/18/26, Plaintiff's counsel withdrew from this case, and the Court directed Plaintiff to either obtain new counsel or inform the Court of Plaintiff's intention to proceed pro se within 30 days. In addition, the Court stayed briefing on the pending Motion to Dismiss #11 . It has been over 30 days, but no attorneys have entered an appearance on behalf of Plaintiff, and Plaintiff has not responded to the Court. Accordingly, the Court assumes Plaintiff is proceeding pro se. The briefing stay on the pending Motion to Dismiss is hereby lifted, and the administrative stay on this case is hereby lifted. Plaintiff's deadline to file a response to the Motion to Dismiss is 5/14/26.
