Bruce on 4/14/2026: Petitioner has filed a Motion #11 and Letter #12 , which has also been docketed in his other pending habeas case before the undersigned judge (26-cv-2068-CSB), his pending civil rights action (26-cv-2088-SLD), and an administratively closed case (26-cv-2067-JEH). The Motion #11 and Letter #12 , seek to have his civil rights action and habeas corpus cases consolidated in some manner. The Court has addressed this request via text order in case 26-cv-2068 and will consolidate the habeas corpus actions only and proceed with habeas review in this case number (26-cv-2065).However, the Court notes that Petitioner also appears to be requesting that his Motion for Leave to Proceed in forma pauperis #7 and Prison Trust Fund Ledger #8 , #10 , that were filed in this case be filed in his civil rights case instead. The Court GRANTS the motion #11 as to this request. The Clerk is DIRECTED to file docket entries #7 , #8 , and #10 in case 26-2088. As Petitioner has already paid the $5.00 filing fee for this case, his Motion #7 is DISMISSED as moot. This matter will now proceed in due course to preliminary review of the petition pursuant to 28 U.S.C. Bruce on 3/13/2026: Petitioner has filed a Petition for Writ of Habeas Corpus #1 , along with two motions for leave to proceed in forma pauperis #2 , #5 . The filing fee is a nominal $5.00. In his first motion, he states he is self employed as a subcontractor and his take home pay was $1500 per week. He writes in both motions that he is making no income while in jail. He has failed to attach a statement certified by the appropriate institutional officer showing all receipts, expenditures, and balances for his institutional account for the two months he has been detained or otherwise provide documentation for his claim that he has no means to pay. Accordingly, Petitioner's motions for leave to proceed in forma pauperis #2 and #5 are DENIED without prejudice. Petitioner must either pay the $5.00 filing fee or file a renewed motion for leave to proceed in forma pauperis with the appropriate documentation. He must do so within 30 days, or the Court will dismiss his Petition #1 without prejudice. The Court notes that it is the rare petitioner that does not have the means to pay the nominal $5.00 filing fee.(RES)
