TEXT ORDER entered by Judge Jonathan Hawley on 4/14/2026: Petitioner has filed a Motion #5 and Letter #6 , which has also been docketing in his pending habeas cases (26-cv-2065 and 26-cv-2068) and his pending civil rights action (26-cv-2088). The Motion #5 and Letter #6 , seek to have his civil rights action and multiple habeas corpus cases consolidated. While these documents were filed in this case, Petitioner filed an earlier motion in this case indicating that he had intended this action to be a civil rights action. Accordingly, this case was administratively closed and a civil rights action was opened (26-cv-2088). Therefore, as it pertains to this case, the Court DENIES Petitioner's motion #5 as moot. (BL)

TEXT ORDER entered by Judge Jonathan Hawley on 3/23/2026: In addition to this case, Petitioner currently has two additional Petitions for Writ of Habeas Corpus pursuant to 28 U.S.C. Section 2254 open in this district pending before Chief Judge Colin S. Bruce in case numbers 2:26-cv-2065 and 2:26-cv-2068. Petitioner has now filed a motion #3 , indicating this case was intended to be a Section 1983 Civil Suit. Petitioner's original filing was labeled "motion to vacate set aside convictions" and sought "relief via 2254, 2255 writ of habeas corpus." (Doc. #1 at 1). However, Petitioner did include a list of defendants using a civil rights action form. Id. at 11-15. Since Petitioner has now clarified he wants this case brought as a Section 1983 Civil Rights Action, his motion #3 is GRANTED. The Clerk is DIRECTED to (1) administratively CLOSE this case and (2) open a new cause of action under 42 U.S.C. Section 1983 with Petitioner's filings. (BL)
