As an initial matter, the Court appreciates the magnitude of the pre-trial discovery in a case such as this and congratulates the parties for their efforts. Based upon Bagley Plaintiffs' Response #85 , it appears all damage calculations have been provided or mailed in discovery as of 10/2/2007 (see page 2 of #85 ). However, the State Officials require that each damage calculation be verified under oath so as to allow proper preparation for trial. The Court does find that the damage calculations are in fact supplemented responses to their interrogatory answers and therefore must be certified / verified by each Bagley Plaintiff.
