Case reopened; defendant's motion for summary judgment (d/e 15) revived. The defendant's motion for summary judgment is granted (d/e 15). All pending motions are denied as moot (d/e's 22, 23 and 24) and, this case is terminated. If the plaintiff wishes to appeal this dismissal, he must file a notice of appeal with this court within 30 days of the entry of judgment. Fed. R. App. P. 4(a).
