Filing 120 OPINION: Summary judgment is GRANTED in favor of the Plaintiff on her false arrest claim against Deputy Koester in his individual capacity (Count VIII) and two excessive force claims against Deputy Koester in his individual capacity (Counts II and IV ). This case will now proceed to trial on the Plaintiff's assault and battery claim against Deputy Koester in his official capacity (Count XIII) and on the issue of damages on the Plaintiff's false arrest and excessive force claims. A tel ephonic status conference is hereby scheduled for Wednesday, August 19, 2015, at 11:00 AM. The Court will place the call.
