TEXT ORDER: Wemple has filed a document he has titled as "The Right to Rule Complaint" (Motion) #8 . However, on September 28, 2012, this Court entered an order dismissing and closing the case and judgment was entered on October 11, 2012. Because the Motion was filed more than 28 days after judgment, the Court will treat the Motion as a Motion for Relief from Judgment under Rule 60 of the Federal Rules of Civil Procedure. TEXT ORDER: Plaintiffs have filed what is styled as a "Class Action Complaint" (Complaint) #1 . Aaron Wemple (Wemple) is the lead plaintiff in this action. Wemple has also filed an Application to Proceed in District Court Without Prepaying Fees or Costs (Application) #2 . Pursuant to 28 U.S.C. 1915(e)(2), this Court shall dismiss a case at any time if the Court determines the action is frivolous or if a plaintiff fails to state a claim on which relief may be granted. The Court has reviewed the Complaint. The claims in the Complaint are inscrutable. To the extent the Complaint's claims are discernable, the claims fail to state a cause of action. Moreover, it appears that the claims are infirm for the reasons explained in prior Court decisions. See Wemple v. All Illinois Judicial Circuits, No. 11-3071 (C.D.Ill. (Apr. 21, 2011)) (dismissing similar claims by plaintiff Wemple pursuant to 28 U.S.C. 1915(e)(2)(B)(i)) and Wemple v. Illinois State Police, No. 05-3034 (C.D.Ill. 2005) (dismissing claims by plaintiff Wemple for failure to state a claim and Eleventh Amendment immunity grounds). Therefore, the Complaint #1 is DISMISSED. The dismissal of the Complaint makes the Application moot. As such, the Application #2 is DENIED AS MOOT. This case is CLOSED. Entered by Judge Sue E.
