Dr. Obaisi's motion for summary judgment is granted, d/e 29 . Judgment to be entered in favor of the Defendants and against the Plaintiff. This case is terminated with the parties to bear their own costs. If the Plaintiff wishes to appeal this judgment, he must file a notice of appeal with this Court within 30 days of the entry of judgment. Fed. R. App. P. 4(a)(4). November 29, 2012 Opinion or Order Filing 6 OPINION entered by Judge Sue E. Myerscough on 12/29/2012. SEE WRITTEN OPINION. The merit review scheduled for December 3, 2012 is cancelled. Pursuant to its merit review of the Complaint under 28 U.S.C. § 1915A, the Court finds that Plaintiff states an Eight Amendment claim against Supervisor Staci for deliberate indifference to Plaintiff's safety and an Eighth Amendment claim against Dr. Obaisi for deliberate indifference to Plaintiff's serious medical needs. Any additional claims shall not be included in the case, except at the Court's discretion on motion by a party for good cause shown or pursuant to Federal Rule of Civil Procedure 15. The Clerk is directed to send to each Defendant pursuant to this District& #039;s internal procedures. Defendants shall file an answer within the time prescribed byLocal Rule. A motion to dismiss is not an answer. This cause is set for further scheduling procedures under Fed. R. Civ. P. 16 on January 28, 2013 at 3:30 p.m. by telephone conference (or as soon as the Court can reach the case) before U. S. District Judge Sue E. Myerscough by telephone conference. Counsel for Defendants is hereby granted leave to depose Plaintiff at his place of confinement. Plaintiff shall immediately notify the Court of any change in his mailing address and telephone number.
