SUMMARY JUDGMENT OPINION: Defendants' Motion for Summary Judgment 51 is GRANTED. The clerk of the court is directed to enter judgment in favor of Defendants and against Plaintiff. All pending motions not addressed below are denied as moot, and this case is terminated, with the parties to bear their own costs. Defendants' Motion for Sanctions 54 is DENIED as moot. OPINION: Plaintiff's petition to proceed in forma pauperis is granted (d/e 2 ). Pursuant to its review of the Complaint, the Court finds that Plaintiff states a federal constitutional claim arising from the condition of his mattress. Plaintiff 's motion for reconsideration of the denial of his motion for a preliminary injunction is denied (d/e 7 ), with leave to renew upon attaching: 1) Plaintiff's medical records from January 1, 2013 to the present; 2) grievances and written co mplaints filed by Plaintiff about the mattress conditions and the responses he has received. This cause is set for further scheduling procedures under Fed. R. Civ. P. 16 on September 30, 2013, at 1:30 p.m., or as soon as the Court can reach the case, before U. S. District Judge Sue E. Myerscough by telephone conference. IT IS FURTHER ORDERED THAT THE CLERK IS DIRECTED TO attempt service on Defendants pursuant to the standard procedures. SEE WRITTEN OPINION. Entered by Judge Sue E.
