Filing 38 OPINION: Defendant Sam Hargadine's Motion to Dismiss 19 is GRANTED. Pursuant to 28 U.S.C. § 1915(e)(2)(B)(ii), the Court dismisses the claims against remaining Defendant Robert Williams without prejudice. All remaining pending motions (d /e 25 , 26 , 33 ) are DENIED AS MOOT. Plaintiff is granted leave to file an Amended Complaint only against Defendant Williams on or before October 30, 2013. Defendant Williams shall answer or otherwise plead on or before November 13, 2013. If Plaintiff does not file an Amended Complaint, the Court will dismiss the case with prejudice.
