Filing 11 MERIT REVIEW OPINION - Entered by Judge Harold A. Baker on 12/18/2015. See written Order. (Rule 16 Deadline 2/16/2016.) The court will wait to delineate the claims until the plaintiffs criminal proceedings have concluded and the plaintiff has been gi ven an opportunity to file an amended complaint. The clerk is directed to send Notice of Lawsuit and Waiver of Service forms to Officers Rowden, Buecker, and Karhliker. Defendant Milhiser is dismissed, without prejudice, because he is entitled to i mmunity on the present allegations. The clerk is directed to terminate John Milhiser as a defendant. A telephone status conference is set for February 9, 2016 at 2:30 p.m. The clerk is directed to prepare the appropriate writ to insure plaintiffs appearance by telephone at the status conference.
