Wi lliams, M.D., and Derik K. King, M.D., will be allowed. The motion to dismiss pursuant to Rule 12(b)(6) of Defendant National Guardian Risk Retention Group, Inc., will be allowed in part and denied in part. Ergo, the motion to dismiss Counts I, II , III and V of Defendants Emergency Consultants, Inc., Central Illinois Emergency Consultants, P.C., James A. Johnson, M.D., Robert M. Williams, M.D., and Derik K. King, M.D. (d/e 87 ) is ALLOWED. Those parties shall be, and hereby are, terminat ed as Defendants. The motion to dismiss of Defendant National Guardian Risk Retention Group, Inc. (d/e 89 ) is ALLOWED in part and DENIED in part. The motion is DENIED as to the breach of contract claims in Count IV. It is ALLOWED as to the fraud claims asserted in Count I and the conspiracy claims of Count II.
