MERIT REVIEW OPINION entered by Judge Sue E. Myerscough on 07/07/2016. SEE WRITTEN OPINION. Plaintiff's complaint is dismissed without prejudice to refiling as a habeas action under 28 U.S.C. § 2241. Plaintiff must still pay the full fil ing fee of $350 even though this case is dismissed. The agency having custody of Plaintiff shall continue to make monthly payments to the Clerk of Court, as directed in the Court's prior order. Plaintiff's motion for counsel is denied as moot 6 .
