OPINION: Defendants' Motion to Dismiss Plaintiff's Second Amended Complaint Pursuant to Fed. R. Civ. P. 12(b)(1) and 12(b)(6) (d/e 32 ) is GRANTED IN PART and DENIED IN PART. Plaintiff shall file, on or before March 12, 2018, an amended complaint clarifying which Counts are brought against which Defendant(s), including that Counts III and VI are brought only against the individual defendants in their individual capacities and Counts VIII and IX are brought only against the Universit y. Counts VI and VII are dismissed without prejudice and with leave to replead. Counts I, II, III, IV, V, VIII, and IX remain.
