OPINION: Plaintiffs' Motion for Partial Summary Judgment 48 is DENIED. Defendants' Motion for Summary Judgment 54 is GRANTED in part and DENIED in part. Defendants' Motion is DENIED as to Counts I, II, IV, and V. Defendants' Motion is GRANTED in part and DENIED in part as to Count III. Defendants' Motion is granted as to Count III to the extent that Plaintiffs cannot pursue a disparate impact type of theory at trial.
