September 28, 2018 Filing 10 MEMORANDUM in Support re #9 MOTION for Default Judgment (Supplement in Support of Motion) filed by Plaintiffs Iron Workers St. Louis District Council Annuity Trust Fund, Iron Workers St. Louis District Council Pension Trust Fund, Iron Workers St. Louis District Council Welfare Fund. (Grabell, Matthew)
September 27, 2018 Opinion or Order TEXT ORDER: Plaintiffs have filed a Motion for Default Judgment (d/e #9 ) in which they request, among other relief, their attorney's fees. The substantiation Plaintiffs provide - an affidavit by Plaintiffs' attorney - does not provide sufficient support to make an accurate determination of the reasonableness of the attorney's fees. Four individuals worked on the case with hourly rates ranging from $225 to $285. The Court has no information about any of the four individuals, other than that attorney Matthew D. Grabell holds the title of Associate Attorney. In addition, the billing summary contains a column for "Invoice Status" and lists some of the entries as "Not Invoiced" and others as "Invoiced." No explanation is provided regarding the distinction between "Not Invoiced" and "Invoiced" and whether this indicates that some of the charges were not billed. Therefore, the Court DEFERS ruling on Plaintiffs' Motion for Default Judgment. Plaintiffs shall file a supplement to the instant motion on or before October 10, 2018, that adequately addresses the issues discussed in this Order. The Clerk is DIRECTED to mail a copy of this Text Order to Siciliano, Inc., c/o Mr. Rick Lawrence, 3601 Winchester Road, Springfield, IL 62707. Entered by Judge Sue E. Myerscough on 9/27/2018.
