December 7, 2018 Opinion or Order TEXT ORDER entered by Judge Colin Stirling Bruce on 12/7/18. On October 23, 2018, the Court noted that Plaintiff had neither paid the required filing fee nor moved for leave to proceed in forma pauperis in this case. The Court gave Plaintiff twenty-one days from the date of that Order to take one of these actions. On November 2, 2018, the Court denied Plaintiff's request to amend his Complaint but gave him leave to try again. In its Order, the Court informed Plaintiff what he must do if he wanted to amend his Complaint, and the Court provided forms to Plaintiff that he could use to amend his Complaint and that he could use to move for leave to proceed in forma pauperis if he could not pay the required filing fee in full. The Court warned Plaintiff that this case could be dismissed if he did not comply with the Court's Orders. Since the Court entered its two Orders, Plaintiff has written letters to the Court, but he has not complied with the Court's Orders. Plaintiff was not required to amend his Complaint or to use the forms provided by the Court, but he was required either to pay the filing fee or move for leave to proceed in forma pauperis. Plaintiff has done neither within the timeframe provided by the Court. Accordingly, this case is DISMISSED WITHOUT PREJUDICE based upon Plaintiff's failure to pay the required filing fee. All pending motions are moot. This case is CLOSED. No judgment to enter. (Civil Case Terminated.) (KM, ilcd)
November 27, 2018 Opinion or Order TEXT ORDER entered by Judge Harold A. Baker on 11/27/2018. Plaintiff's motion for counsel #8 is DENIED with leave to renew upon demonstrating that he has made attempts to hire his own counsel. Pruitt v. Mote, 503 F.3d 647, 654-55 (7th Cir. 2007). This showing typically requires writing to several lawyers and attaching their responses. If Plaintiff renews his motion, he should set forth how far he has gone in school, any jobs he has held inside and outside of prison, any classes he has taken in prison, and any prior litigation experience he has. Finally, the Court will not typically attempt to recruit counsel until Plaintiff can demonstrate or has demonstrated that he has or can state a claim upon which relief can be granted at a merit review of his Complaint. November 2, 2018 Opinion or Order TEXT ORDER entered by Judge Harold A. Baker on 11/2/2018. Plaintiff's motion for leave to file an amended complaint #5 is DENIED. The Court does not accept piecemeal amendments to pleadings. If Plaintiff desires to amend his Complaint to add a Defendant, to add a claim, or to substitute a Defendant, he should file a motion seeking leave to do so in which he identifies the changes that he desires to make in his Complaint. In addition, Plaintiff should attach a complete, proposed amended complaint that, if granted leave to file, will completely replace his original Complaint and will stand on its own without reference to or reliance upon his Original Complaint. Flannery v. Recording Indus. Ass'n of Am., 354 F.3d 632, 638 n.1 (7th Cir. 2004). The proposed Amended Complaint should explain what Defendants did or did not do, including the proposed new Defendant(s), and why their actions or inactions violated Plaintiff's constitutional rights. The Clerk of the Court is directed to send the forms necessary to file a section 1983 case to Plaintiff. The Court strongly encourages Plaintiff to use these forms to file an amended complaint. Once the Court receives Plaintiff's proposed amended complaint, the Court will conduct a merit review of that proposed amended complaint that is required by 28 U.S.C. Section 1915A.
