December 27, 2018 Opinion or Order TEXT ORDER entered by Judge Joe Billy McDade on 12/27/2018. Plaintiff has submitted an affidavit and petition to proceed in forma pauperis, claiming that he had no income at all in the past year. His prison trust fund ledgers, however, indicate that he has received f $1275 in this period, some of it from payroll "state pay." In addition, Plaintiff received regular income from Eunice Schlosser and received a sum of $350.66 which might be the result of a settlement. As Plaintiff revealed none of this on his petition, despite his attesting under penalty of perjury as to the petition was true and accurate. It is clear, therefore that Plaintiff's petition is at best, in error and at worst, fraudulent. Plaintiff's petition to proceed in forma pauperis #3 is DENIED. Plaintiff will have 30 days (1/26/2019) in which to pay the $400 filing fee or submit a corrected petition identifying his sources of income. Failure to do either will result in the dismissal of this case, without prejudice. (VH, ilcd)
