TEXT ORDER entered by Judge Colin Stirling Bruce on 6/5/2019. Plaintiff has accumulated at least five strikes pursuant to 28 U.S.C. Section 1915(g). Taylor v. Dammermann, 19-cv-497 (S.D. Ill.)(5/16/19 order) Therefore, Plaintiff cannot proceed in forma pauperis under 28 U.S.C. 1915(g), unless he is in imminent danger of serious physical injury. Plaintiff has filed a complaint alleging he is in imminent danger because Sangamon County Jail officials refuse to place him in protective custody status. First, Plaintiff admits jail staff offered to move him to segregation and it is unclear whether the jail has protective custody status. Second, Plaintiff has made several wide ranging and vague claims about threats to his safety. Plaintiff refers only to threats from unspecified gangs and he appears to believe he is not safe in any location. Before the Court can consider Plaintiffs IFP motion or even whether he has adequately alleged Defendants failed to protect him, Plaintiff must clarify his claims. Therefore, Plaintiff's initial complaint is dismissed as a violation of Rule 8 of the Federal Rules of Civil Procedure. Plaintiff must file an amended complaint within 21 days. His amended complaint must specifically state who threatened Plaintiff, how he was threatened, and when he was threatened. Plaintiff must also state when he alerted each named Defendant to a specific threat to his safety and what information he provided. If Plaintiff fails to file his amended complaint within 21 days or on or before June 26, 2019, his case will be dismissed.(SAG, ilcd) |
