TEXT ORDER entered by Chief Judge Sara Darrow on 9/3/2019. Plaintiff, who is currently detained in the Sangamon County Jail, seeks leave to proceed in forma pauperis. Plaintiff cannot proceed in forma pauperis unless he is in imminent danger of serious physical injury. Plaintiff alleges that he meets this exception because he has been denied his prescribed psychiatric and seizure-disorder medications. The Court ordered a response by Jail Superintendent Larry Beck. That response, which Plaintiff does not dispute, demonstrates that Plaintiff is not under imminent danger of serious physical injury. Plaintiff's petition to proceed in forma pauperis is, therefore, denied. #3 . Mr. Beck's avers that Plaintiff has been regularly seen by nurses, medical professionals, and mental health professionals. (Beck Aff. 20-21, 29.) Plaintiff does not dispute that he is intermittently compliant with his medications and was discovered to be hoarding medicine on July 24, 2019. Id. 41. One of Plaintiff's psychotropic medications has been discontinued, but Plaintiff is still offered Xanax. Plaintiff's anti-seizure medicine, Dilantin, was discontinued on July 24, 2019, because of Plaintiff's noncompliance, but Dilantin continues to be available to Plaintiff on a daily basis. Id. 51. According to Mr. Beck's inquiry, Plaintiff has not shown signs or symptoms of seizure activity since Plaintiff was returned to the Jail on April 13, 2019. Id. 55. This case is dismissed without prejudice and closed. Plaintiff may file a motion to reopen within 30 days attaching payment for the $400.00 filing fee. (KE, ilcd) |

TEXT ORDER entered by Chief Judge Sara Darrow on 8/1/2019. On July 29, 2019, Plaintiff filed the complaint in this action along with a petition to proceed in forma pauperis. Plaintiff cannot proceed in forma pauperis because he has accumulated at least three strikes under 28 U.S.C. 1915(g), unless he is in imminent danger of serious physical injury. Plaintiff alleges that he is in imminent danger of serious physical injury because, as of July 25, 2019, certain Defendants at the Sangamon County Jail refuse to give Plaintiff his prescribed medications for his psychiatric disorders and his seizure disorder. Plaintiff has a pattern of making unsubstantiated allegations of imminent danger. See, e.g., Taylor v. Campbell, et al., 19-cv-3111 (docket entries 7, 8.) Nonetheless, the Court is concerned about Plaintiff's allegations that he is not being given his medications. The clerk is directed to send a waiver of service to Defendant Beck (the Jail Superintendent) along with the Complaint. No other Defendants will be served at this time. Judge Bruce is dismissed as a Defendant based on grounds of absolute immunity for his rulings and because Judge Bruce is not responsible for dispensing medications at the Jail. By August 9, 2019, Defendant Beck is directed to respond to Plaintiff's allegations. The Court will determine whether Plaintiff may proceed in forma pauperis after reviewing Defendant Beck's response. The clerk is also directed to send this order and a copy of the complaint to: (1) Plaintiff's public defender Stephanie Hammer, Sangamon County Public Defender, 200 South 9th Street, Room 301, Springfield IL 62701; and (2) Attorney Karen McNaught, who filed an appearance in one of Plaintiff's prior cases (19-cv-3111.)
