TEXT ORDER granting #8 Petition to Proceed In Forma Pauperis. Pursuant to 28 U.S.C. Section 1915(b)(1), Plaintiff is assessed an initial partial filing fee of $21.15. The agency having custody of Plaintiff is directed to forward the initial partial filing fee from Plaintiff's account to the Clerk of Court. After payment of the initial partial filing fee (or immediately if no funds are available for that payment) the agency having custody of Plaintiff is directed to make monthly payments of 20 percent of the preceding month's income credited to Plaintiff's account to the Clerk of Court. Income includes all deposits from any source. The agency having custody of the plaintiff shall forward these payments each time Plaintiff's account exceeds $10, until the filing fee of $350 is paid in full. TEXT ORDER entered by Judge Joe Billy McDade on 10/11/2019. Plaintiff has submitted an affidavit and petition to proceed in forma pauperis #3 . Plaintiff denies receiving gift income, claiming that his only income is $28.80 per month from his prison job. His prison trust fund ledgers, however, show regular income from at least two individuals in addition to work income. Plaintiff's petition appears to be incomplete or in error and is DENIED #3 . Plaintiff will have 30 days in which to pay the $400 filing fee or submit a corrected petition identifying the sources of his income. Failure to do either will result in the dismissal of this case, without prejudice.(SAG, ilcd)
