December 3, 2019 Opinion or Order TEXT ORDER entered by Judge Colin Stirling Bruce on 12/3/2019. On November 13, 2019, the Court received-returned as undeliverable-mail that it had sent to Plaintiff. The same day, the Court issued a Text Order reminding Plaintiff of his obligation to keep the Court informed of his address and giving him fourteen (14) days to provide the Court with his new address in writing. As of today, Plaintiff has not informed the Court of his current address in writing as required by Local Rule 16.3(K) and by the Court's Order. Local Rule 16.3(K) requires every pro se plaintiff to inform the Court of any change of address that occurs during the pendency of his case. Failure to comply with this Local Rule results in the dismissal of the case. Id. Accordingly, this case is DISMISSED WITHOUT PREJUDICE based upon Plaintiff's failure to comply with Local Rule 16.3(K) and with the Court's Orders. No judgment to enter. All pending motions are denied as moot in light of the dismissal of this case. (KE, ilcd)

November 7, 2019 Opinion or Order TEXT ORDER entered by Judge Colin Stirling Bruce on 11/7/2019 granting #2 Petition to Proceed In Forma Pauperis. Pursuant to 28 U.S.C. Section 1915(b)(1), Plaintiff is assessed an initial partial filing fee of $16.72. The agency having custody of Plaintiff is directed to forward the initial partial filing fee from Plaintiff`s account to the Clerk of Court. After payment of the initial partial filing fee (or immediately if no funds are available for that payment) the agency having custody of Plaintiff is directed to make monthly payments of 20 percent of the preceding month`s income credited to Plaintiff`s account to the Clerk of Court. Income includes all deposits from any source. The agency having custody of the plaintiff shall forward these payments each time Plaintiff`s account exceeds $10, until the filing fee of $350 is paid in full. The Clerk is directed to mail a copy of this order to Plaintiff`s place of confinement, to the attention of the Trust Fund Office. (KE, ilcd)
October 31, 2019 Opinion or Order TEXT ORDER entered by Judge Colin Stirling Bruce on 10/31/2019. Plaintiff's motion to request counsel #3 is DENIED. The Court generally will not consider recruiting counsel for a pro se plaintiff until the Court determines that he possess a claim upon which relief can be granted after the Court conducts a merit review of the complaint. Plaintiff may renew his motion if his claim survives a merit review that the Court will conduct in the near future. Finally, Plaintiff has filed a motion for leave to proceed in forma pauperis. However, he has not signed his petition. Accordingly, the Clerk of the Court is directed to send the form to Plaintiff with which he may move for leave to proceed IFP in this case. Plaintiff must complete this form, including signing the form under penalty of perjury, and must return the completed, signed form to the Court within fourteen (14) days from the date of this Order. If Plaintiff does not return a complete, signed IFP application, the Court will deny his motion, and he will need to pay the entire filing fee, up front, in order to proceed with this case.
