January 16, 2020 Opinion or Order Filing 13 TEXT ORDER entered by Judge James E. Shadid on 1/16/2020. On November 15, 2019, the pro se Plaintiff filed his complaint and a motion to proceed in forma pauperis (IFP). The Plaintiff's IFP motion did not included the required copy of his Trust Fund ledgers. Plaintiff's IFP application also stated he had not received any income from any source including gifts or a job in the last 12 months #5 . However, when the Court received the trust fund ledgers, it showed Plaintiff had received $435.30 in gifts and other income during his four months of incarceration. Plaintiff was reminded any document filed with the Court must contain accurate, truthful information. Therefore, his motion was denied. See December 5, 2019, Text Order. Plaintiff was directed to either pay the $400 filing fee, or file a new IFP motion with accurate information. Plaintiff was advised if he failed to take any action on or before December 19, 2019, his case would be dismissed. The Plaintiff has taken no further action. On its own motion, the Court will allow Plaintiff another opportunity to file an IFP motion or pay the filing fee. If Plaintiff does not have enough money to pay the filing fee, he can file a new IFP motion, but he must list or estimate how much money he receives in gifts or from other sources. Plaintiff should also indicate whether he has any outside accounts. The Clerk is to send Plaintiff another IFP application. Plaintiff must either pay the $400 or file a completed IFP application within 14 days or on or before January 31, 2020. If Plaintiff again fails to take any action, his case will be dismissed. The Clerk of the Court is also directed to reset the internal merit review deadline for February 7, 2020.(SAG, ilcd)
December 5, 2019 Opinion or Order TEXT ORDER entered by Judge James E. Shadid on 12/5/2019. Plaintiff has filed a motion to proceed in forma pauperis (IFP) claiming he has received no income from gifts, a job, an outside account, or any other source in the last 12 months #5 . However, Plaintiff's Trust Fund Ledger obtained by the Clerk of the Court indicates Plaintiff has received $435.30 in gifts and other income during his four months of incarceration. Plaintiff is reminded any motion filed with the Court must contain accurate, truthful information. Intentionally misleading the Court could result in sanctions or an inability to proceed IFP. Therefore, Plaintiff's motion is denied #5 . Plaintiff must either pay the $400 filing fee in full or file a new motion to proceed IFP with accurate information within 14 days or this order. Plaintiff must list any income from any source and must clearly indicate if he has any outside accounts. In addition, Plaintiff must state whether he has received a settlement in any other case in the last 12 months, or whether he anticipates a settlement check in the next 6 months. If Plaintiff fails to pay the $400 filing fee or file a new IFP motion with accurate information on or before December 19, 2019, his case will be dismissed without prejudice.(SAG, ilcd)
