MERIT REVIEW AND CASE MANAGEMENT ORDER entered by Judge Harold A. Baker on 3/12/2020. Pursuant to its merit review of the Complaint under 28 U.S.C. Sec 1915A, the court finds that the plaintiff states First Amendment claims for retaliation and denial of access to the courts and an Eighth Amendment claim for deliberate indifference to a serious medical need against Defendants Sheffler, Smith, Durell, Crary, and Goins. Any additional claims shall not be included in the case, except at the court's discretion on motion by a party for good cause shown or pursuant to Federal Rule of Civil Procedure 15. The clerk is directed to enter the standard qualified protective order pursuant to the Health Insurance Portability and Accountability Act. The clerk is directed to attempt service on the named defendants pursuant to the standard procedures. Plaintiff's motions to preserve evidence #4 #5 are denied. Plaintiff effectively seeks an injunction preventing officials at his present facility from forcing him to decide whether he wants certain personal property sent home or destroyed. The Court does not have jurisdiction over these officials in this case, and Plaintiff has not indicated why sending these items to his home or a place of his choosing would not preserve this evidence for purposes of this case. As a courtesy to Plaintiff, the Court will attempt to find a lawyer via the Seventh Circuit Bar Association. Plaintiff is advised that he should not stop trying to find counsel on his own, and the Court's efforts at this time do not guarantee that counsel will be recruited. The number of prisoners seeking pro bono counsel greatly exceeds the number of attorneys the Court has found willing to volunteer in these types of cases. The Court makes no findings at this time regarding Plaintiff's efforts to obtain counsel or his ability to litigate this case on his own. Pruitt v. Mote, 503 F.3d 647, 654-55 (7th Cir. 2007). TEXT ORDER granting #3 Petition to Proceed In Forma Pauperis: Plaintiffs petition for leave to proceed in forma pauperis is granted #3 . Pursuant to 28 U.S.C. Section 1915(b) (1), Plaintiff is assessed an initial partial filing fee of $83.52. The agency having custody of Plaintiff is directed to forward the initial partial filing fee from Plaintiff's account to the Clerk of Court. After payment of the initial partial filing fee (or immediately if no funds are available for that payment) the agency having custody of Plaintiff shall make monthly payments of 20 percent of the preceding month's income credited to Plaintiff's account to the Clerk of Court. Income includes all deposits from any source. The agency having custody of the plaintiff shall forward these payments each time Plaintiff's account exceeds $10, until the filing fee of $350 is paid in full.
