TEXT ORDER entered by Judge Sue E. Myerscough on 4/24/2020. On April 7, 2020, the Court denied Plaintiff's petition to proceed in forma pauperis because he had received over $1,500 since September 2019. Plaintiff has filed a motion to withdraw his complaint, asserting that he cannot pay the fee because the pandemic has made it impossible for his family to continue to make contributions, but he does not detail those circumstances. Plaintiff also appears to ask in a letter whether dismissing his complaint without prejudice creates a new filing deadline for statute of limitations purposes. The Court cannot give legal advice or an advisory opinion on the statute of limitations (which would not be binding in any event). The Court construes Plaintiff's motion to withdraw his complaint as a motion for an extension to pay the filing fee. If Plaintiff cannot pay the filing fee by June 30, 2020, Plaintiff may file a motion to waive the filing fee, attaching his trust fund ledgers from April 1, 2020 through June 30, 2020. If Plaintiff does not pay the filing fee or file a motion to waive the filing fee (with ledgers attached) by June 30, 2020, then this case will be dismissed without prejudice. Plaintiff's petition to proceed in forma pauperis is denied #3 because Plaintiff receives regular additions to his trust fund account and should be able to pay the $400 filing fee. According to Plaintiff's trust fund ledgers, Plaintiff has received over $1,500 since September 2019, spending most of that in the commissary. Plaintiff is directed to pay the $400 filing fee by May 7, 2020 or this case will be dismissed without prejudice for failing to pay the filing fee. (KE, ilcd)
