TEXT ORDER entered by Judge Colin Stirling Bruce on 1/6/2021. On December 30, 2020, the Court directed Plaintiff to file an amended complaint. Based upon that Order, Plaintiff's motion for leave to file a piecemeal amendment to his original complaint #9 is DENIED. In addition, Plaintiff's motion to request counsel #7 is DENIED. The Court generally will not consider recruiting counsel for a pro se plaintiff until the Court determines that he possess a claim upon which relief can be granted after the Court conducts a merit review of the complaint. Plaintiff may renew his motion if his claim survives a merit review of his proposed amended complaint. Finally, Plaintiff's motion for copies #8 is DENIED. Plaintiff is a frequent filer with this Court. Therefore, Plaintiff knows that, if he wants the Court to make and provide copies of documents filed with the Court, he must first pay ten cents per page for those copies. Accordingly, Plaintiff's motion for copies is denied until he pays the fee associated with the Court making copies for him. (KE, ilcd) |

TEXT ORDER entered by Judge Colin Stirling Bruce on 12/30/2020. Plaintiff's motion to enter Defendants #4 and motion to enter information #5 is DENIED. Essentially, Plaintiff's motions seek to amend his Complaint by providing additional Defendants and additional information regarding his claim(s). However, the Court does not accept piecemeal amendments to pleadings. If Plaintiff desires to amend his Complaint to include additional information, to add a Defendant, to add a claim, or to substitute a Defendant, he should file a motion seeking leave to do so in which he identifies the changes that he desires to make in his Complaint. In addition, Plaintiff should attach a complete, proposed amended complaint that, if granted leave to file, will completely replace his original Complaint and will stand on its own without reference to or reliance upon his Original Complaint. Flannery v. Recording Indus. Ass'n of Am., 354 F.3d 632, 638 n.1 (7th Cir. 2004). The proposed Amended Complaint should explain what Defendants did or did not do, including the proposed new Defendant(s), and why their actions or inactions violated Plaintiff's constitutional rights. Plaintiff should file a proposed amended complaint within twenty-one (21) days from the date of this Order if that is his desire to do so. Otherwise, the Court will conduct a merit review of Plaintiff's Complaint as soon as practicable. (KB, ilcd) |
