TEXT ORDER: In the Response brief filed at d/e #24 , Plaintiff asserted that "if the [Western District of Michigan] were to transfer and if KV chooses not to pursue in that forum, KV would simply dismiss the transferred case upon arriving in the Central District pursuant to Federal Rule of Civil Procedure 41." This action has since been transferred from the Western District of Michigan to this District. Moreover, the defendants in a related case, Case No. 20-cv-3204 (the "Customer Case"), have moved under the customer-suit exception to stay the Customer Case until this case is resolved on the merits. It is ORDERED that Plaintiff and Defendant shall each submit, no later than March 4, 2022, a brief addressing the issue of whether this case and the Customer Case, and/or this case and Case No. 20-cv-3231, Design Ideas v. Target, should be consolidated pursuant to Fed. R. Civ. P. 42. Plaintiff's brief should additionally address the issue of whether Plaintiff intends at this time to voluntarily dismiss this case, or to move for dismissal of this case, pursuant to Fed. R. Civ. P. 41. The Court hereby SETS a status hearing in this matter and in the Customer Case for Tuesday, March 8, 2022, at 11:00 a.m. At the status hearing, the parties should be prepared to discuss consolidation, dismissal, and the appropriateness of a stay of this case or the Customer Case.
