Prior to the hearing neither the Plaintiff's nor Co-Defendants filed any response to said motions. For the reasons stated in the motions and information provided at the hearing, the motions to compel are GRANTED. Plaintiff Jaeger, the Doyle Plaintiffs, Fleet Defendants and Hyundai are ORDERED to provide discovery responses to Defendant RDX, LLC within 14 days, on or before October 30, 2023. Additionally, at the hearing on October 17, 2023, counsel for Plaintiff Jaeger, Patrick Cummings indicated that attorney Patrick Anderson would be withdrawn as counsel and Mr. Cummings would be filing an appearance. Attorney Cummings is ORDERED to file an appearance within the next 14 days, on or before October 30, 2023, to ensure there remains counsel of record for Plaintiff Jaeger. Mr. Jaeger seeks leave to amend the First Amended Complaint to omit the claim against Defendant Hyundai Motor America. Federal Rule of Civil Procedure 15(a) provides that a court should freely give leave [to amend] when justice so requires. Fed. R. Civ. P. 15(a). This mandate is to be heeded. Foman v. Davis, 371 U.S. 178, 182, 83 S.Ct. 227 (1962). Since a complaint merely serves to put the defendant on notice, a complaint may be freely amended or constructively amended as the case develops. Toth v. USX Corp., 883 F.2d 1297, 1298 (7th Cir. 1989). The Court finds no reason to deny Mr. Jaeger leave to amend his First Amended Complaint. Accordingly, Mr. Jaeger's Motion, d/e #43 , is GRANTED. The Clerk is DIRECTED to docket pages seven through thirty-five of Plaintiffs Motion d/e #43 as Plaintiff Richard Jaeger's Second Amended Complaint. A telephonic Rule 16 Scheduling Conference set Wednesday, 11/30/2022, at 1:00 PM (court will place call) before U.S. Magistrate Judge Karen McNaught.
