The Clerk of the Court is directed to enter judgment in Defendant's favor and against Plaintiff. This case is CLOSED. If Plaintiff wishes to proceed in forma pauperis on appeal, his motion for leave to appeal in forma pauperis must identify the issues that he will present on appeal to assist the Court in determining whether the appeal is taken in good faith. If so, the Warden, or his designee, is FURTHER DIRECTED, also within FOURTEEN (14) DAYS of the entry date of this Order, to deduct $402.00 from plaintiffs inmate account and send it to the Clerk as previously ordered. IT IS FURTHER ORDERED that plaintiff must, within FOURTEEN (14) DAYS of the entry date of this Order, submit to the Clerk a copy of his inmate trust account statement showing the balance in that account on November 30, 2021.
